Action is being taken to evict a trio of ponies from disused land in Epsom.
Worried residents have repeatedly raised concerns about the welfare of a horse, nicknamed Chantilly Filly, which appeared in Chantilly Way after the Epsom Derby in 2012.
Two more horses later joined Chantilly Filly but the RSPCA maintained that its officers could not remove the horses just because they were on their own and without shelter.
But Epsom and Ewell Neighbourhood Inspector Craig Knight said he received a letter dated August 19 from the Department of Health which owns the land in Chantilly Way.
Insp Knight said: "The property team say they are going to look to take action to remove the horses. I’m pleased that they are taking action to resolve what has been a historic issue for the community."
He said the DoH property team were looking to essentially evict the horses and take action against the horse owners.
A DoH spokesman confirmed that they have written to police over the horses in Chantilly Way. He said: "We are arranging for notices to go up regarding the removal of the horses."
The horses are on land which was formerly part of the Epsom Cluster of psychiatric hospitals which became part of the NHS.
